The Hidden Legal Risk of Using AI-Generated Headshots:

There's really no way to sugar-coat this so here it is. Using an AI-generated headshot could be extremely hazardous to your brand and your reputation, but not for the reason you think.


As far as quality goes, I will say that AI-generated photos are getting better. They still have some room for improvement though, as with the example above. I uploaded my actual headshot (left) and asked AI to create a headshot for me. You can see the AI-generated photo (right) looks nothing like me and is a little distorted. Plus, not even on my best day have my teeth been that flawless.


That's not the scary part though. What's really frightening about using an AI-generated headshot is when the AI gets it right and produces a photo that looks just like you - that you may not have rights to control.


The Real Issue: Who actually owns the AI-generated photo?


Under U.S. copyright law, protection is only granted to original works of authorship created by a human being.


This principle has been reinforced repeatedly by the U.S. Copyright Office, most recently in its guidance on AI-generated content, which you can read here. https://www.copyright.gov/ai/.


If an image is created entirely by artificial intelligence without meaningful human creative input, it is not eligible for copyright protection.


That means:

  • You may not have exclusive rights to control how the image is used.

  • You may have limited ability to prevent copying or misuse.


The worst case scenario is if your headshot falls under Public Domain. What “Public Domain” really means:


If your headshot falls into the public domain:

  • Anyone may be able to use it… especially where no other rights (like likeness or publicity rights) apply.

  • It can be copied, altered, or redistributed without your permission for any personal or commercial use.

  • You may have no legal recourse under copyright laws.


Imagine yourself driving to work and seeing your face on a competitor's billboard, a pharmaceutical ad, or worse. For professionals building a brand image, that’s a serious risk.


What about those AI systems that create a headshot from selfies you upload? That may not save you. It really depends on how the AI creates your headshot. Some AI systems will edit your images to create the headshot, but some don't. Some systems will use your selfies to guide the AI, but the AI creates the image entirely from scratch. In this case, you would own the original selfies you took, but the AI-generated result would not qualify for copyright protection.


You may have some ground to seek legal recourse depending on how your AI-generated headshot is used, but at the potential cost of thousands of dollars in legal fees. Is saving a few bucks on a photo worth risking control over your image?


Here's the best thing I can recommend. When you hire a professional photographer, ownership, rights, and usage are all clearly defined and protected by copyright laws. The stress is off of you. If you decide you really want to shop for AI-generation software for your business photos, I highly recommend consulting with an intellectual property attorney who specializes in copyright law first. Get the best advice from experts before you move on AI.
